1. Agreement to Terms

By accessing or using the Mardell application (the "App") and its services, you agree to be bound by these Terms of Use ("Terms"). Please read them carefully. If you do not agree to all of these Terms, you may not access or use the App.

2. User Agreement

You agree to use the App only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the App. You are responsible for all activity that occurs under your account.

3. Account Registration and Use

To book a room, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and agree not to disclose it to any third party. You must notify us immediately of any unauthorized use of your account.

4. Booking Process

Listings on the App constitute invitations to offer. When you book a room via the App, you are making an offer to the host to book the room for the specified dates and price. The booking is confirmed when you receive a confirmation from us or the host, as specified in the booking process.

5. Payment Terms

The prices for rooms are listed on the App and may be subject to change. You agree to pay the total fees for any booking you make, including the room price, applicable taxes, and any other fees disclosed during the booking process. Payment will be processed using the payment method you provide. By providing your payment information, you authorize us to charge you for the total fees.

6. Cancellation and Refund Policy

Cancellation policies vary depending on the room and the host. You are responsible for reviewing and understanding the specific cancellation policy applicable to your booking before you confirm it. Refund amounts, if any, will be determined by the applicable cancellation policy.

7. User Conduct

You agree not to use the App to: (a) upload, post, email, transmit, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable; (b) impersonate any person or entity; (c) forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the App; (d) upload, post, email, transmit, or otherwise make available any content that you do not have a right to make available under any law or under contractual or fiduciary relationships; (e) upload, post, email, transmit, or otherwise make available any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party; (f) interfere with or disrupt the App or servers or networks connected to the App; (g) violate any applicable local, state, national, or international law.

8. Intellectual Property

The App and its original content, features, and functionality (including but not limited to text, graphics, logos, images, and software) are and will remain the exclusive property of Mardell and its licensors and are protected by copyright, trademark, and other laws.

9. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MARDELL, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE APP.

11. Indemnification

You agree to indemnify, defend, and hold harmless Mardell and its affiliates, directors, officers, employees, agents, suppliers, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of or relating to these Terms or the App shall be instituted exclusively in the federal or state courts located in Ogun State, Nigeria. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

13. Modifications to Terms

We reserve the right to modify or revise these Terms at any time, and we will post any changes on this page. Your continued use of the App after any such changes constitutes your acceptance of the new Terms. It is your responsibility to periodically review these Terms.
